Employment Authorization Documents No Longer Automatically Extended for Some Applicants

The Department of Homeland Security and U.S. Citizenship and Immigration Services (USCIS) have announced a significant policy change that affects certain employment authorization documents (EADs). As of October 30, 2025, certain EADs will no longer automatically renew, which impacts trucking companies and other employers who rely on workers with these documents. Under an interim final rule published in the Federal Register, the automatic extension practice for certain EADs ended on October 30, 2025. Previously, applicants with certain work visas could receive an automatic work authorization extension of up to 540 days if they filed a renewal application before their EAD expired. This allowed workers to continue working while their application was being processed.

Important Notice for Employers

Under the new policy, Form I-797C (Notice of Action) and receipt notices will now state that the document is not evidence of employment authorization and cannot be used by itself or when presented with an expired EAD as proof of employment authorization.
